Proposition 65 As of Nov 2008, warning labels must be placed on all invoices sent to California residents purchasing nutritional supplements.
In spite of the fact that Designs for Health products meet and exceed
the very strict product safety requirements of the FDA, we have been
advised by legal counsel to place a Proposition 65 warning label on all
invoices sent to the state of California. Perhaps you have already
seen these types of warnings on invoices from other nutritional
supplement companies, on other products sold in your state, and posted
in a variety of locations throughout your state. It is also likely you
will begin to see a similar warning from all nutritional supplement
companies selling in California. The warning label reads:
WARNING: These products may not be in conformance to
California Proposition 65 requirements and may contain a chemical known
to the State of California to cause cancer and birth defects or other
reproductive harm.

grounds that forcing manufacturers to make this warning is a violation of free

CALIFORNIA PROPOSITION 65 WARNING
WARNING: These products contain chemicals known to the State of California to cause cancer and birth defects or other reproductive harm.
Why Are You Receiving This Warning? Proposition 65 is a portion of the California Health and Safety Code that requires disclosure to consumers of exposures to certain chemicals listed by the State of California. There are now over 800 listed chemicals. Listed chemicals include lead, and other metals commonly found in food products or ingredients. Listed chemicals such as lead and other metals exist naturally in the environment and can be present in foods and ingredients due to natural processes, such as uptake via root systems in plants.
Proposition 65 does not limit how much of a listed chemical can be present in a product. Rather, Proposition 65 requires disclosure of the presence of lead and other listed chemicals under some circumstances. Almost always, the Proposition 65 disclosure level is far below the levels other regulatory agencies, like the United States Food and Drug Administration, set for other regulatory purposes.
